I transfered title over to my ex (car title) we had a promissary note that she would take over payments,insurance and maintenance i also have witnesses that seen her sign it. she has not made any payments for three months ,the finance company wants to repo the car or have somebody make the late payments. I cant pay in time before they repo it. I cant find the car but she keeps telling me that she will bring the car to me . the car is in HER name but she hasnt registered it or put inssurance on it .she told the finance company she would make the payments %26amp; asked for an extra month to so she could make the payment. she has not ! The car is now in BAD condition (crashed).my credit will soon be ruined what should i do ....serious comments only please!!! i need advice . can i repo the car or transfer title back to my name.? if you have reference info that would help too.

I think you should make a deal with the financing company, but let them have the car back, and sue your ex for the amount that you have paid or are paying, the promissory note should be proof enough that she owes the money, not you. You could always contact one of the T.V. courts like Judge Hatchett, Judge Judy or the like.

If your name is not on the loan, you%26#039;re ok. It%26#039;s her responsibility. However, if you are on the loan (and it sounds like you are), you%26#039;re responsible for making the payments whether your name is on the title or not. You should be able to get the car titled back into your name as long as your ex will sign off on the title. You should contact the finance company and explain your situation to see if they will work with you in making up for late payments. If you have something in writing from your ex saying that she was going to pay for the car, maybe contact a lawyer to see if you can sue her.

if you repo the car and put it back in your name, you have to consider the benefits of doing that. how wrecked is it? how did she get it transferred without ins. on it? i am sorry for what you are experiencing. is the loan for the car in your name? have you had insurance on it during the time of the wreckage and would you be willing to file on the insurance? if you cannot afford to make the late payments before the time they want to repo it, you may have to count it as a loss. most lenders are willing to overlook this type of thing on your credit report when you explain a rough divorce and an ex that didn%26#039;t meet up to her end of the bargain. a lot of your questions also depend on the state in which you live. if you try to repo the car, you could always try to sue for damages on the vehicle and the fees that you incurred because of her irresponsibility. i hope you can get the situation straightened out without going through more stress.

The finance company doesn%26#039;t care HOW they get their money. If the car is NOT in your name, or you are NOT a co-signer, let it go!
If, on the other hand, you are a co-signer, it would be in YOUR best interest to make the payments.

You better talk to a lawyer since you don%26#039;t understand that since your name is on the loan and the car is probably collateral, transferring it to her name would be considered FRAUD.
